Terms and Conditions
1. Contract of Hire:
All bookings accepted by Bitez Tourism/Bitez Villa are subject to these conditions which are deemed to have been accepted in full by the hirer and all persons in the booking party. We reserve the right not to accept any booking. By making a booking, the first-named person on the booking agrees on behalf of all persons detailed on the booking that:
a. The
person has read these terms and conditions and has the authority to and does
agree to be bound by them,
b. The person consents to our use of information per our Privacy Policy
2. Alterations and/or
Cancellations made by Bitez Tourism/Bitez Villa:
In
the unlikely event that a villa becomes unavailable due to circumstances beyond
the control of Bitez Tourism/Bitez Villa, the hirer will be offered alternative
accommodation of a similar standard. If no suitable accommodation can be
offered, a full refund of the monies already received by Bitez Tourism/Bitez
Villa for the villa rental will be refunded. Any refund is restricted to the
villa hire costs and we are not liable for any cancellation or administration
charges for travel arrangements, flight tickets etc.
3. Included in your booking:
The
villa rental includes the cost of a weekly cleaning, delivery of bed linens and
towels (one bath towel and one hand towel per guest), end of stay clean, water,
electricity, gas, maintenance of swimming pool and garden. Any defects or
deficiencies must be reported within 24 hours of your arrival. After this time
it will be assumed that everything is in order and you may be held responsible
for paying damage costs.
4. What is NOT included in
your booking:
The
villa rental prices do not include: personal, travel or cancellation insurance,
airport transfers, full resort representation, or damage/breakage deposit,
further fees can and will be requested. Satellite TV, DVD/CD player, pool
lights, garden furniture etc. are free items, therefore the availability or
function of any such item cannot be guaranteed. In most cases satellite
transmission will only receive a limited number of channels and, unlike the UK,
the satellite transmission can be unreliable and channels can be lost.
5. Occupancy:
Only
persons Only persons listed on the booking form may occupy the villa, the villa
cannot be re-let or sublet to any other group/party or individual without the
written approval of Bitez Tourism/Bitez Villa. No other persons are permitted
to stay at the accommodation nor can you arrange for visitors to the property
for events such as: parties, celebrations or other large gatherings, unless
this has been agreed with us in writing and appropriate payments made (if
applicable). Additional guests may and will be asked to vacate by person in
authority.
Under no circumstances may more than the maximum number of persons specified in the villa description, or booking form, occupy the villa except by prior written agreement of Bitez Tourism/Bitez Villa. Bitez Tourism/Bitez Villa or their representatives, reserve the right to refuse admittance to the villa to the hirer and their party if they are in breach of this condition, thus triggering the hirer cancellation protocol. We do not accept pets or animals of any kind or smoking into our villas.
6. Hirer’s Responsibilities
for Villa:
The hirer is responsible for taking all reasonable care
of the property and its contents. At the end of the hire period, the property
and its contents, including all equipment, furniture, utensils, etc must be
left clean and tidy which includes the crockery and cutlery cleaned and stored
in the appropriate cupboards, and ensuring that the cooker, oven, fridge and
microwave are clean. The hirer shall ensure that no member of the party engages
in any activity in or around the villa and swimming pool which may cause
damage, offence to the neighbours, pollution to the water or damage to the structure
or filtration equipment, this includes unacceptable anti-social behaviour. The
hirer shall also ensure that the barbecue is cleaned and that all rubbish is
cleared away from the property and placed in the communal dustbins. On
departure you should leave the accommodation in a reasonably clean and tidy
condition so that we can efficiently prepare it for our next guests.
7. Damage
to Villa and its Contents:
For any damage found during departure from the villa, except
in the case of normal wear and tear, the hirer will be responsible for coverage
of all damages incurred. This includes damages found through the occurrence of
negligence, those made willfully or as a result of irresponsible behaviour by
those occupying the villa. Such damage must be reported immediately to Bitez
Tourism/Bitez Villa or a representative. The costs of replacement or damage
will be paid for by the hirer to the owner via Bitez Tourism/Bitez Villa. A
deposit of at least £150 is to be held against damage to the property,
furnishings, excessive cleaning requirements or unnecessary call-outs,
including those outlined above in Section 10. The deposit is to be paid in cash
on arrival to villa owner/representative and will be refunded into the renters account
after the villa inspection on the day of departure.
8. Rights of Access:
Bitez Tourism/Bitez Villa, representatives of, or their
subcontractors have the right of access to the villa at any time with due
regard to the convenience of the hirer for any of the following: linen changes,
garden and pool maintenance, an inspection of the property and to carry out any
essential or routine repair or maintenance work. Before entry to the property,
an attempt to contact hirer or member or hiring party will be made.
9. Responsibilities
of Bitez Tourism/Bitez Villa:
Neither Bitez Tourism/Bitez Villa nor their representatives
can be held responsible for any circumstances beyond their control including,
but not limited to, mechanical breakdown, illness, swimming pool maintenance,
emptying of swimming pool for necessary maintenance, failure of any public
service supply. The hirer responsible for booking undertakes that no person
will suffer anything to be done which would endanger the policy of the villa
owner’s insurers in respect of the villa and its contents which may make the
same void or voidable.
10. Injury
and Damage:
Bitez Tourism/Bitez Villa is a booking agent working on
behalf of the owners of the properties we offer and, as such, your contract is
with the owner. We do not have any responsibility to compensate you for any
personal injury, illness, death, loss of goods, accidents or damage of any
nature suffered by you, or any member of your party, during the booking period
or thereafter.
11.
Accuracy of Information:
We always take a great deal of care to work with our owners´
to make sure that the information and photographed images contained within our
website are correct. However, all our villas are privately-owned and therefore
owners may make changes in their homes to details like decoration, furniture
and fittings. All information supplied by Bitez Tourism/Bitez Villa is given in
good faith and is based upon information available at the time. All reasonable
measures have been taken to ensure accuracy, but Bitez Tourism/Bitez Villa and
their representatives are not liable for any variation in any way caused.
12. Villa
Arrival and Departure Times:
The villa will be available for occupation from 16:00 local
time on the day of arrival unless stated otherwise and must be vacated by 10:00
AM on the day of departure.
13. Keys,
Directions and Emergency Contact:
Detailed instructions for key collection, entry to and
directions to the villa will be sent to the hirer prior to the rental
commencement. These details will be received together with a local contact
number of a representative working on behalf of Bitez Tourism/Bitez Villa
available to you 24 hours of the day, for use in the event of any reasonable
issue or emergency.
14.
Complaints:
In the unlikely event that you have a complaint about the
villa or its contents whilst on holiday, it must be reported immediately to
Bitez Tourism/Bitez Villa or its representatives who will take reasonable
measures to resolve the matter on behalf and in liaison with the owner of the
property. Neither Bitez Tourism/Bitez Villa nor their representatives shall
have any liability for any complaint submitted after the completion of the hire
period.
15.
Building Work:
In the event of building works, those organised by local
authorities, private developers or neighbours, we are not responsible for and
are unable to stop such work taking place. We are also unable to control noise
levels occurring as a result of such building work.
16. Force
Majeure
Bitez Tourism/Bitez Villa does not accept liability to pay
any compensation where the performance or prompt performance of our contractual
obligations is prevented or affected by ‘force majeure’. In these Terms and
Conditions, ‘force majeure’ means any event which Bitez Tourism/Bitez Villa or
the supplier of the service(s) in question could not, even with due care,
foresee or avoid. Such events may include but are not limited to, war, the
threat of war, civil commotion or strife, hostilities, strikes or other
industrial disputes, natural disasters, earthquake, ash clouds, fire, acts of
God, terrorist activities, quarantine, epidemics, weather conditions,
government action or other events outside our control.
17.
Insurance:
The cost of villa hire does not include any personal insurance
cover of any kind. It is a condition of booking that insurance to cover
cancellation is acquired and the acquisition of accident and medical insurance
is also strongly recommended.
18. Law and
Jurisdiction:
Bitez Tourism/Bitez Villa acts solely as an intermediary
booking agent on behalf of the property owners. The rental contract is
ultimately between the property owner and the hirer. Any disputes arising from
the hire of the property will be resolved between the hirer and the owner. This
agreement shall be governed by the laws of Turkey to which both parties
expressly submit.
